RULES OF THE SOFITEL BOUTIQUE LOTTERY 2024

ARTICLE 1. DEFINITIONS

The following terms, when capitalized, shall have the meanings set forth below:

Administrator:

  • The company Hotels at Home, S.A.S., a French company registered under the number (SIRET) 477 579 874 00025, with its registered office at 163 Rue de la Belle Etoile, Business Park Paris Nord 2 - Bât 6B, 95700 Roissy en France.

Organizers:

  • The company Accor SA, with its registered office at 82 Rue Henri Farman, CS 20077, 92445 Issy Les Moulineaux.
  • The company Hotels at Home, S.A.S. ("HAH"), a French company registered under the number (SIRET) 477 579 874 00025, with its registered office at 163 Rue de la Belle Etoile, Business Park Paris Nord 2 - Bât 6B, 95700 Roissy en France.

ARTICLE 2. ORGANIZATION

The Organizers and the Administrator organize an operation allowing the award of a prize by a draw (hereinafter referred to as "the Lottery").

The conditions of participation, award, and receipt of the prize within the framework of the Lottery are governed by these rules (hereinafter referred to as the "Rules"), which are accessible, viewable, and downloadable at the following link: https://sofitelboutique.com/en/win/rules.

ARTICLE 3. PARTICIPATION

The Lottery is open to individuals legally residing in Europe who, on the day of participation, are at least eighteen (18) years old or have reached the age of majority in their state/country of residence, if the age of majority exceeds 18 years in their state/country of residence (hereinafter referred to as the "Participant").

Participation in the Lottery implies acceptance, without reservation, of these Rules and constitutes, on the part of the Participant, a total and unconditional acceptance of the decisions of the Organizers and/or the Administrator regarding the Lottery.

Excluded from the Lottery are individuals not meeting the above conditions, employees, officers, and directors, as well as their immediate family members (spouses, parents, children, siblings, regardless of their place of residence) and anyone living under the same roof (whether or not related) as the Organizers and the Administrator, as well as their parent companies, affiliates, subsidiaries, franchisees, agents, representatives, consultants, subcontractors, legal advisors, advertising, public relations, promotional, coupon management and marketing agencies, website providers, website administrators are not eligible to participate and cannot be designated as winners.

Participation in the Lottery is strictly personal and nominative.

The Participant can only win a prize if they meet all the conditions set forth in these Rules.

The Organizers and/or the Administrator reserve the right to verify that the winner meets the eligibility conditions before awarding a Prize.

ARTICLE 4. TERMS OF PARTICIPATION

Participation in the Lottery is free of any purchase obligation.

To participate, click on the link below corresponding to your country of residence and complete all required fields of the registration form displayed on the screen.

Entries must be received by 11:59 PM French time on 09/02/2024 to be eligible for the Lottery.

Any attempt by a Participant to enter more than once, using multiple email addresses, multiple identities, registrations, and logins, or by any other method, will void those entries and may result in the Participant's disqualification at the discretion of the Organizers and/or the Administrator.

The use of an automated system or computer system to participate is prohibited and will result in the Participant's disqualification. Access and internet usage fees imposed by your service provider may apply. Standard data transmission fees may apply if you use a mobile device to participate.

The Participant is solely responsible for the identity and contact information provided when submitting their entry form.

Incomplete, inaccurate, corrupted, or late entries will be void and disqualified.

The Organizers are not responsible for lost, late, incomplete, damaged, stolen, or misdirected entries; network, server, or other connection, lost, interrupted, or inaccessible connections; or communication errors, computer or software malfunctions, telephone transmission problems, technical failures, truncated computer transmissions, damage to any computer system (software and hardware), or any other error or malfunction of any kind, human, mechanical, electronic, or other, that are not attributable to them.

ARTICLE 5. DURATION

The Lottery will run from 06/24/2024 at 6:00 PM to 09/02/2024 at 11:59 PM. Any participation outside these dates and times will be void.

During this period, one (1) draw will be held to designate the winner.

The Organizers reserve the right to extend, shorten, or modify the duration of the Lottery at any time, especially in cases of force majeure, without any compensation being claimed by the Participants. The Rules, as modified by addendum(s), will be updated and made accessible on the site.

ARTICLE 6. SELECTION AND ANNOUNCEMENT OF THE WINNER

The winner of the prize will be chosen by computerized random draw from all eligible entries received during the Game Duration. The draw will be conducted by the Administrator using RandomPicker.com. RandomPicker.com is an independent organization.

The winner will be notified by email at the address provided during participation.

To obtain the identity of the winner, a communication will be available for ninety (90) days after 09/12/2024, by sending a self-addressed, stamped envelope to: SOFITEL BOUTIQUE LOTTERY 2024, WINNERS LIST, HOTELS AT HOME, 163 rue de la Belle Etoile, Business Park Paris Nord 2 – Bât 6B, 95700 ROISSY EN FRANCE.

The winner will receive an email with an eligibility and liability release declaration ("Declaration") which they must complete, sign, and return by email to the following address, customer.service@sofitelboutique.com, within fourteen (14) days following notification to receive their Prize.

If the winner does not respond within seven (7) days following the first contact attempt, a second attempt will be made. If the winner does not respond within seven (7) days following this second attempt and/or if the Prize notification is returned to the Organizers, or if the designated winner refuses the Prize or is not eligible, the winner will be considered to have forfeited the prize. To receive the Prize, all requirements specified in these Rules must be met.

The eligibility of the designated winners is verified by the Organizers and/or the Administrator before sending the Prize.

ARTICLE 7. PRIZE

The prize is a Sofitel MyBed™ bed or a two-night stay in a Sofitel hotel.

Approximate Retail Value ("ARV") of the Prize: €3,240 for the Sofitel MyBed™ bed or €1,600 for the two-night stay in a Sofitel hotel, at €800 per night. The actual value may vary according to price fluctuations and applicable promotions. Nights are subject to the availability of the chosen hotel. The winner cannot claim the difference between the actual value of the prize and the approximate retail value. Travel expenses are not included. Accompanying guests must sign a liability release.

TOTAL ARV OF THE PRIZE: €3,240 or €1,600

ARTICLE 8. PRIZE DELIVERY

The Prize will be delivered directly by the Organizers' customer service by contacting the email address provided at the time of participation.

The winning Participant accepts the Prize as offered, without the possibility of exchange or refund, particularly for cash, other goods or services, compensation, or any other remuneration, of any kind, other than that specified by these Rules.

The Prize is strictly nominative and cannot be transferred, in any form or by any method, to a third party.

ARTICLE 9. PRIZE RESTRICTIONS

The Prize does not include the payment of transportation or ancillary travel expenses.

The winner and their guests are entirely responsible for their travel arrangements to the hotel. The Organizers are not responsible for travel failures by any transportation company and will not provide any compensation or reimbursement, except at their sole discretion.

The winner and their guests are responsible for optional travel insurance (and any other form of insurance) and acknowledge by these Rules that the Organizers have not and will not purchase travel insurance or any other form of insurance.

All costs and expenses related to accepting and using the Prize that are not specifically mentioned herein remain the sole responsibility of the Prize winners.

The Prize does not include costs and expenses (such as, for example, security fees, gratuities, baggage fees, meals, ground transportation, and incidental expenses) related to accepting and using the Prize.

The Prize must be booked within the calendar year in which the prize is awarded, otherwise, the winner will automatically forfeit the Prize.

Prize booking is subject to the availability of the hotel rooms as determined by the hotel, and the stay cannot be combined with other offers.

The winner and their guests must ensure they have valid identification and travel documents at the time of the stay.

A recognized credit card will be required upon arrival to cover any incidental fees. Each of the winner’s guests (or the winner as the parent/legal guardian of a minor guest and the winner's dependent child) may be required to sign a liability release before the stay.

ARTICLE 10. OBLIGATIONS OF THE WINNER AND THEIR GUESTS

The winner and their guests undertake to adhere to customary good conduct rules and avoid any behavior that could disparage or harm the reputation of the Organizers.

The winner and their guests are fully responsible for any behavior causing damage to the Organizers and third parties. The Organizers cannot be held responsible for any damage caused by the winner or their guest to third parties.

The winner and their guests are subject to potential sanctions from the Organizers, including early termination of their stay, in case of threatening, insulting behavior, or behavior damaging the reputation, image, and/or fame of the Organizers or their services, products, trademarks, service marks, or logos.

The winner and their guests are responsible for any taxes resulting from the awarding and acceptance of the Prize, regardless of their nature.

ARTICLE 11. LIABILITY

The Organizers and/or the Administrator cannot be held responsible for direct or indirect damages occurring due to a force majeure event.

The Organizers and/or the Administrator are also not responsible for any errors regarding the name, address, and/or contact details provided by the Participants.

The Organizers and their service providers and partners cannot be held responsible for any incidents that may occur during the use of the Prizes by the beneficiaries once they have received them.

Furthermore, the Organizers disclaim any responsibility in case of suspension, malfunction, inability to participate, or any other disruption that may occur on their website, which are not attributable to them and/or to the Participant and constitute an inherent risk of the Internet.

The Organizers may cancel all or part of the Lottery if it appears that violations of the Rules, fraud, or any artificial means (and/or attempts) have occurred in any form in connection with participation in the Lottery.

In this case, the Organizers reserve the right not to award the Prizes to the Participant(s) and/or to take legal action against them.

ARTICLE 12. REIMBURSEMENT OF CONNECTION FEES

Participants can obtain reimbursement of their connection fees to the site related to participation in the Lottery upon written request.

The reimbursement is a flat amount of €0.50, regardless of the actual costs incurred to access the Lottery.

To obtain a reimbursement, you must send your request, along with the necessary justifications, to the following address:

Proof of expenses incurred to access the Lottery may be requested. The costs incurred (current slow postage rate) by the Participant for this request will be reimbursed upon simple request.

All reimbursement requests must be sent before 09/17/2024, as evidenced by the postmark.

ARTICLE 13. USE OF PERSONAL DATA

Participants' information is recorded, used, and stored by the Organizers for the processing of their participation and the awarding of Prizes.

Participants may, for legitimate reasons, object to their personal data being processed within the framework of the Lottery.

To exercise these rights, you can write an email to customer.service@sofitelboutique.com or to the following postal addresses, in both cases, with the reference "Data Protection – LOTTERY SOFITEL BOUTIQUE 2024," enclosing a photocopy of your valid ID or passport, at any time and free of charge, for the purposes described below:

  • Hotels at Home, S.A.S., 163 Rue de la Belle Etoile, Business Park Paris Nord 2 - Bât 6B, 95700 Roissy en France.
  • Revoke consents granted.
  • Obtain confirmation that the Organizers are processing your personal information.
  • Access your personal data.
  • Correct inaccurate or incomplete data.
  • Request the deletion of your data when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
  • Obtain from the sponsor the restriction of data processing when one of the conditions provided for in the data protection regulation is met.
  • Request the portability of your data.
  • Object to the processing of your data.
  • File a complaint with the corresponding data protection authority when you believe that the Organizers have violated the rights recognized by the applicable data protection regulations.

By accepting these Rules, the Winner authorizes the Organizers and the Administrator to disseminate, on any media (television, press, audio, etc.), their first and last name, for the purpose of communicating the results of the Lottery, without granting them any right to compensation, a right or any advantage, other than the awarding of their Prize.

In accordance with the latest version of the French Data Protection Act and Regulation No. 2016/679 of the European Parliament and Council of April 27, 2016, concerning the protection of individuals with regard to the processing of personal data and the free movement of such data (GDPR), the Participant may exercise their right of access, rectification, erasure of data, restriction of processing, data portability, right to object, and right to withdraw consent by writing to the Organizer at the address mentioned in Article 1.

ARTICLE 14. CONSUMER DISPUTE MEDIATION

After contacting the Organizers, and in the absence of a satisfactory response within 30 days, the Participant may refer the matter to a Mediator, whose contact details are:

The mediator's mission is to attempt, independently and impartially, to bring the parties together to reach an amicable solution. However, the Participant is free to accept or refuse mediation and to take the matter to the competent courts.

The subscriber is also informed that they have the possibility to use the European Online Dispute Resolution (ODR) platform to resolve their disputes: www.ec.europa.eu/consumers/odr/

ARTICLE 15. LANGUAGE OF THE RULES

The Rules are written in French. Any translation provided, communicated, or made available to the Participant in any form and by any means is for informational purposes only, and the French version shall prevail.

ARTICLE 16. APPLICABLE LAW

These Rules are subject to French law for their validity, interpretation, and execution, subject to the application of more protective mandatory provisions of the Participant's place of residence.

ARTICLE 17. COMPETENT JURISDICTION

The action brought by the Participant against the Organizers may be brought either before the courts of the Member State in which the Organizers are domiciled or before the court of the place where the Participant is domiciled.

The action brought against the Participant by the Organizers may only be brought before the courts of the Member State in which the Participant is domiciled, as notified to the Organizers at the time of their participation in the Lottery.

ARTICLE 18. BLOCTEL SYSTEM

The Participant, who does not wish to be subject to telephone solicitation, declares being informed of the right to register on the opposition list to telephone solicitation, provided for in Article L223-1 of the Consumer Code, on the website www.bloctel.gouv.fr or by mail addressed to Société Worldline – Service Bloctel CS 61311 – 41013 Blois Cedex Opposetel, Service Bloctel – 6, rue Nicolas Siret – 10 000 Troyes. Any person registered on this list cannot be solicited by phone, except in case of pre-existing contractual relations or when the person concerned has expressly requested it, for a period freely set by them or, failing that, within 3 months from the date of their request.

This registration is free and valid for three years from the confirmation of their registration on said list.

ARTICLE 19. INTELLECTUAL PROPERTY

Reproduction, representation, or exploitation of all or part of the elements composing the Lottery or the Rules are strictly prohibited.

All trademarks, logos, texts, images, videos, music, and other distinctive signs reproduced on the site and on the sites accessible through hypertext links are the property of the Organizers.

Unauthorized reproduction of any of the aforementioned elements, without this list being exhaustive, constitutes an infringement of intellectual property rights and is subject to penal sanctions.

ARTICLE 20. ACCESS AND COMMUNICATION OF THE RULES

The Rules are made available by the Organizers on the Lottery page at the following link and can be downloaded in a durable format: https://sofitelboutique.com/en/win/rules.

The Rules can be sent in a durable format, free of charge, to anyone who requests them from the Organizers at customer.service@sofitelboutique.com.

The Organizers disclaim all responsibility for any technical, graphical, and typographical errors or omissions that may be contained herein.

ARTICLE 21. EVIDENCE AGREEMENT

By express agreement between the Participant and the Organizers, the Organizers' computer systems and files shall prevail, the Participant retaining the possibility of providing contrary evidence.

The computerized records, kept in the Organizers' computer systems, under reasonable security and reliability conditions, are considered as proof of the relationships and communications between the Organizers and the Participant.

It is therefore agreed that, except in the case of a manifest error, the Organizers may rely on, for the purpose of proving any act, fact, or omission, the programs, data, files, recordings, operations, and other elements (such as monitoring reports or other statements) of a computer or electronic nature or format, established, received, or stored directly or indirectly by the Organizers, including in their computer systems.

These elements thus constitute evidence and, if they are produced as evidence by the Organizers in any contentious or other proceedings, they will be admissible, valid, and enforceable between the parties in the same manner, under the same conditions, and with the same probative force as any document that would be established, received, or stored in writing.

Any operation, of any nature, carried out using the identifier and the code assigned to a Participant, following registration, is presumed to have been carried out under the responsibility of the Participant.
